CHP Change of Address
CHP Change of Address
Good morning all.
I recently moved out of Fairfax County where my CHP was issued. I still live in VA. I have already changed my address with the DMV. Is it now illegal for my to carry concealed? Am I not allowed to carry until I can make time to get back to Fairfax County Courthouse to get a new permit issued?
Thanks!

The short answer is, you are still legal. You are not required to file a change of address, but I don't see where it would hurt to do so.
P.S. IANAL

Re: CHP Change of Address
I have moved in state 3 times and have never changed my CCW address. There is no requirement for me to do so. I have the note from the DMV that accompanies my DL but it is also no correct.
The only problem was buying two guns a month or even 1 without other supporting ID.

So, Mike, how many times have you moved in state? Was it about as many times as you posted your response?

Re: CHP Change of Address
No requirement to change CHP address however the clerk is obliged by law to do so if you request...I rarely use mine as the second ID. Voter card works just as good and should be current like your DL. IMHO if you dont have a current voter card then you probably dont need a CHP or a gun...

Re: CHP Change of Address
Let me start of by saying SHAME ON ME for not running a forum search for this topic before I took a day of leave from work and drove out to Spotsylvania County yesterday to get a replacement permit.
When I first obtained my permit I must have moved around a half dozen times before it expired - so having different addresses showing on my permit and drivers license was a real concern of mine as well. Back then I thought I had covered my six by putting the question to the issuing clerk of court who informed me that a change of address does not require you to ask for a replacement permit.
Well, after sitting somewhat still in one location for 5-years I just moved again and I found this question itching the back of my brain housing group once more. I went back to the VA State Police website and felt vindicated with my original belief that you were not required to update your permit in this situation.
I next made a couple of calls to the clerks of court from both my former (issuing) and current circuit courts. In both cases I was told in no uncertain terms that I must obtain a replacement permit from the original issuing authority which reflects my new address or I could go full hog and renew my permit in my new jurisdiction. Sitting on my existing permit with an incorrect address showing was not an option.
Clearly, I am weak. A better man than I would have stood his ground and fought the good fight - or just do what I did in the past and let my permit ride - but I caved and accepted the word that passed down to me like a good little sheep-man hybrid.
I am still new to these forums so I hope this confession does not get me banished.

The emphasis on the word "shall" is mine. At no point does that statement tell me that I must update my permit. That should have been the end of my story, but I am a glutton for punishment. The clerk of a circuit court that issued a valid concealed handgun permit shall, upon presentation of the valid permit and proof of a new address of residence by the permit holder, issue a replacement permit specifying the permit holder's new address.

I wish that you had taken our Intro to Concealed Carry in Virginia class. That is one of the statutes that we discuss and I would have given you the straight poop.
