Colapsible Baton

Post by spanky1953 »

I recently asked the Virginia State Police for the restrictions, if any, on carrying a colapsible baton, concealed or not concealed, in Virginia. What I got back was a link to the Virginia Code concerning firearms for personal defense - ALL OF IT. I am not a lawyer, and it would take a very good one to read the entire section of legal crap that they sent me, and be able to tell me if I would be arrested for carrying a baton according to the Code. Can anyone on this site tell me 1) Can you legally carry an colapsible baton (not a spring stick) in Virginia. 2) If the answer to 1 is yes, can it be carried concealled?

18.2-308 is the applicable law - and it says nothing about a baton. It does mention weapons "of like kind", but I don't believe a baton fits any of the descriptions.

I would say (IANAL) that a baton is legal to carry concealed or otherwise.

I thought a spring stick and a collapsible baton were two very different things.

Anyway, I don't think a collapsible baton is covered by my reading of the code.

A spring stix extends under it own power (spring)...and a collapsible baton extends by cintrifical force of "flipping" it open by flicking your wrist...

So i do believe that these are two different items ( * IANAL * ) and i do belive that you can CC a collapsible baton...

I would check with your local PD, as at least you will get some idea of thier education level on the subject...
Good luck!
Be particular, and be vigilant, as the enemy will only attack on two occasions:
When you're ready or when you're not ready.

Also never forget, that everyone who shows up, is not necessarily there to help.
