Military, out-of-state DL, live in VA, work in DC

Post by awiz11 »

I am military, have a ND driver's license, live in VA, and work in DC. Tried to buy a handgun this p.m., took my orders (To Bolling AFB, DC), had my car registration (Woodbridge, VA address), military ID and was all set...or so I thought. Gander Mountain gun counter guy (The supervisor) told me he couldn't sell me the handgun since my orders were to DC, even though I was living in VA...was he correct?

Do you have anything stating you live in Va. besides car registration? They require 2 id's with the same address.

Hate to say it but I think he was right. Check this page, it's in there- http://www.vsp.state.va.us/Firearms_VFTP.shtm

From the VSP page-

Military Personnel

Active military personnel permanently stationed in Virginia are treated as Virginia residents for the purchase of a handgun. Identification and residency are established by the following:

A military photo-identification card issued by the United States Department of Defense and proof that Virginia is the permanent duty station via current military assignment orders is acceptable identification and residency documentation to establish military personnel as residents of Virginia.

If permanently assigned to a mobile unit in Virginia, and the homeport is listed as Virginia; the transaction may be processed as a Virginia resident the same as any other permanent military assignment to Virginia supported by military assignment orders. The individual is treated as a non-Virginia resident if the homeport is listed as any place other than Virginia.

Individuals retired from military service are subject to the same identification and residency requirements as any other person wishing to purchase a firearm; i.e., a primary and secondary form of ID.

Hiwaytahell, I had several bills, etc. with me, that showed my address was in Woodbridge, VA, but his sticking point was my military orders were to a base in DC (Bolling AFB), regardless that I live in VA

Moccasin, I think my problem is that I'm permanently "stationed" at Bolling AFB, DC, even though I reside/live in Woodbridge, VA

I think I'm screwed...even the Gander Mountain guy told me it would be next to impossible to buy a handgun in DC...very frustrating!

Moccasin is correct. It's where you're stationed, not your home address that counts.

I agree that it's frustrating

One option is to trade your ND drivers license for a VA drivers license then wait 30 days- it's my understanding that you can't purchase firearms for the first 30 days after a drivers license is issued in VA.

Maybe think about getting a VA drivers license, if that is an option? You will have to give up your ND one though if you go that route.
