Al Sharpton's daughter sues city
Al Sharpton's daughter stumbled on uneven pavement and sprained her ankle walking across the street. Now she is suing for $5 MM from the city street maintenance.
Al Sharpton owes 4.5 MM in back taxes.
Perhaps they should tell her that they will consider her injuries after her father pays his taxes.
Sounds like he raised her right, doesn't it?

No surprise that a worthless piece of garbage would raise up another worthless piece of garbage.

The apple doesn't fall far from the tree, does it? Funny how she can post all kinds of pictures of her hiking trails and climbing mountains around the world...

What bothers me is how in these kinds of situations people can project "future" sufferings - they haven't experienced them yet but are sure they are going to happen.

I always wondered why the good citizens of ________ city don't file a class action lawsuit against folks like this for frivolous lawsuits....

I think this chic is completely full of it and its just a scam, but I can explain the "future" suffering aspect.wittmeba wrote:What bothers me is how in these kinds of situations people can project "future" sufferings - they haven't experienced them yet but are sure they are going to happen.
Lets say hypothetically you got into a car accident where you got hit by someone. You get damage to your spine, are suffering in pain, and the damage is permanent per multiple doctors. That means the pain and limitations are permanent and likely will only get worse with time.
Since several doctors confirm and you are in pain and disabled permanently, wouldn't you want lifetime medical and compensation for things like future pain, future loss of earning capacity, future medical expenses etc. from that other person's negligence? Those are legit losses and legit pain you are stuck with for life. Just because it hasn't been experienced yet, that doesn't mean its not coming and predictable.

Marc I do understand. I was just comment (sarcastically) to the person (daughter of Al), what we already know about her hiking, climbing ladders, etc. with a sprained ankle.

Principle is to compensate people for a "loss". This kind of "damages" (future pain and suffering) used to not be recoverable as a rule because they were speculative/couldn't be proved and/or just weren't deemed compensable. Seems to me like I remember something about there had to be a physical manifestation of the so-called "injury" (but that may have been for "mental anguish") But as first lawyers, then courts, legislatures, and the general public increasingly climbed on the "something for nothing" bandwagon, this kind of thing has become more and more common. Our company once had a semi driver pick up a hitchhiker then wreck and kill him. Guy went through the windshield and his head punched into a limestone bank. In the early 1980s, a court awarded the guy's parents well over $100,000 for the "pain and suffering and mental anguish the deceased suffered in the fraction of a second that elapsed between the time the truck hit the bank and his head hit the bank after going through the windshield. Normally, they could/would have sued for the present value of the guys future lifetime earnings, but in that case, the guy was a bum that had flunked out of several schools, gotten kicked out of the Army, couldn't hold a job even working for his own father, and hadn't filed a tax return in 7 or 8 years. Bottom line: It has long since come down to any excuse to pick an insurance company's pocket; and the average jury is too stupid to know that when they make a gift out of an insurance company's pocket, they pay for it when they buy insurance.
