CHP and the Law

Post by alby »

If you have a CHP and enter a business which does not post a sign saying "No Firearms Allowed", but has a
company policy of No Firearms, does the CHP holder have to inquire about the policy of the business?
What I mean is, do you have to request permission and/or policy for each business you enter?

Or is the law setup in a way where its a "Don't Ask, Don't Tell" policy. In that, if the business never confronts
you about your firearm you never have to tell them you have one on you?

I've not been able to figure it out on way or the other. IMO if they don't post it where you can see it, you're allowed to carry until told otherwise. It may be their company policy to prohibit firearms but if I am NOT an employee why would I be concerned with their policy? VSP website says it is unlawful to carry on "Private property when prohibited by the owner of the property, or where posted as prohibited." (VA code 18.2-308) If it isn't posted and nobody tells you it's prohibited, I wouldn't ask. It seems to me that it's on the owner to inform you.

If they do not have a sign saying no guns then I don't worry about it .

Once again, their RULE, and THAT is all it is, a rule. If you are ask to leave, and don't, then the trouble starts. No, you don't have to ask, why would you. :)

Thanks. It would appear that the law is worded in a way that its the private property owner's
responsibility to post a "no guns" sign and/or inform people of their policy, instead of it being
the CHP holder's responsibility. That is good. I did some digging and found the word for word
listing in the Virginia Code. I've listed it below:

§ 18.2-308. Personal protection; carrying concealed weapons; when lawful to carry.
http://leg1.state.va.us/000/cod/18.2-308.HTM
.
.
.
O. The granting of a concealed handgun permit shall not thereby authorize the possession of any handgun or other weapon on property or in places where such possession is otherwise prohibited by law or is prohibited by the owner of private property.

If I am carrying concealed and I don't see a "No guns allowed" sign when I enter a business establishment, I just keep quiet and go about my business. If the manager notices I am carrying and tells me to leave, then I leave but I will politely tell him to post a sign on the door so people like me don't have to patronize his business. Just me.

And by "Trouble", he means that you could be charged with trespassing.
