The language "while under the influence" doesn't help much. The criteria Proshooter set out above actually represent a fair degree of reasonable restraint by law enforcement, if you think about it.
If they should ever adopt the "zero tolerance" policy applied by schools to guns, a thimble full of alcohol would arguably put you "under the influence". The "influence" would be infinitesimal, but the alcohol would still be affecting your system. And the statutory language doesn't say HOW MUCH under the influence, now, does it?
This may not be as silly as it sounds right now. We've just been talking about how the "zero tolerance" shenanigans in our schools were absolutely unthinkable a generation ago. And we already have plenty of anti-gun and anti-drinking-alcohol groups out there; many of whom can be expected to urge extreme measures to further their cause. And, unlike the situation with the guns, there is no constitutional protection for consuming alcohol, and there is already a statute that says CC is prohibited while "under the influence" while not specifying the degree of influence.
Makes you want a good stiff drink, doesn't it?

Dude... just don't do it. Don't "toe the line"... we as gun owners don't need the additional headlines on channel 12 news talking about "some guy drunk in public carrying a handgun". It may be legal in some forms like OC but it just aint smart.

Nope, only need an ABC license to SELL alcohol.
