First Time NFA Purchase - CLEO Signature In Henrico?

Will it be a problem to obtain the CLEO signature needed for an NFA purchase in Henrico County? I've heard that Henrico PD refuses to sign off. Is there anything I should know?

In case anyone's wondering, it looks like it's near impossible to get a signature in Henrico. It's such arbitrary nonsense. VCDL should push for a Tennessee style law where the General Assembly enjoins CLEOs to sign off provided the purchaser is eligible to own a firearm.

Some people use trusts when the CLEO simply won't sign unless you're a political contributor or friend (it really is corruption on the CLEO's part IMHO). Trust offer more important benefits such as allowing you and "other close family" to possess the item and avoid constructive possession. For example, mine allow either my wife or I to possess the NFA items, otherwise she could be deemed to be in possession when I go to work and she knows the combos/has the keys. It doesn't matter what she actually does, the simple fact that she could constructs that idea that she was in possession. Pure BS, but that's how it works.

another vote for a trust. Easy to use, easy to setup, and solves a number of constructive possession problems.

I was under the impression that the ATF is now going to require a CLEO signature for all trusts? Maybe I'm wrong about that?

There is a proposed rule making order published, but its not an official change yet.

Also the forms were planned to be changed in such a way that it would be easier for the CLEO's to sign off.

Oh, so trusts are still acceptable without the CLEO sign off? That would be the way to go for me. Any idea on how I would create one? Should I hire a lawyer or can I do it myself?

I'd use a lawyer. A good NFA trust creation service will not only be creating a legal entity for purchase, and holding of NFA items, it will also come with instruction and guidance for you and your heirs on how to use the trust properly.

I've had good interactions with http://www.arsenalattorneys.com/ and I know quite a few people who have worked with him.

I used http://www.guntrustlawyer.com. Goldman/Apple law firm is very well known in the NFA community and his trusts are very well prepared.

Awesome, thanks! I'll probably use the second website you provided.

Is there a timetable on when the new requirements take effect? I need to know how much time I have to work with. I definitely want to purchase three surpressors and if my budget allows, I'd like to get an SBR as well.

I imagine that once the new rules take effect, I won't be able to purchase any new NFA items until I move which probably won't be for two or three years so I need to get what I really want before the CLEO signature requirement is extended to trusts.

The proposed rule is public for comments, then the ATF has to review comments, and then either amend it and perhaps another comment period, or publish with a to be effective date.

I agree, we should ask our state legislators to enact such a law. I have talked to two of my legislators about it and have found that they are favorable to the idea. However, we will need VCDL or the NRA to back the law for it to actually get passed. (And, we would need a 2A friendly Gov. to sign it too :-) )

If any of you are interested in pushing this proposal with your legislator or VCDL or NRA, then start pushing it NOW. State legislators are already starting to work on bills that they want to submit in front of the General Assembly in January.

It just makes sense, from both the perspective of the purchaser of an NFA restricted item as well as the CLEO who signs the form. It would take away the CLEOs concern, right?

By the way, are you affiliated with the company in your signature?
