Hi folks,

Quick question - what happens if you are "made" carrying concealed? Lets say you go somewhere, Wal-Mart for example, where you are perfectly legal to carry. You bend over to check a price on a bottom shelf and your jacket raises above the bottom of your holster, revealing either your holster, your gun, or both. What is the penalty for this if someone were to call the police ?

Penalty?
This answer assumes you are a CHP holder:

Virginia allows open carry if you are legally able to carry.
If you are on private property and it isn't your private property (stores shopping centers, etc, etc, etc), then you are subject to whatever their weapons policy is and they can ask you to leave if they so choose.

If you are not a CHP holder, then check out the links on the left for more information.


In either case, there are places you aren not legally allowed to carry open or concealed. Once again, check out the links to the left.

What Spanish said but to add. VA is an open carry state.. If the firearm becomes exposed in most cases you are OK since VA is an open carry state.. Your CHP allows to to conceal your firearm.. It has always been legal to open carry prior to CHP licensing/laws..

Other states are not open carry so your firearm becoming exposed would be a crime in other states. Some of these same states carry a charge of brandishing if you print..

As a CHP holder, I don't worry about it, and I carry my LC9 or my XD-S everywhere in a bellyband holster that hides the firearm exceptionally well. If someone should happen to see something and has something to say, so be it - I have a permit. That being said, I'm very confident that the gun is well-concealed and wouldn't show no matter what gyrations my body makes.

Should someone ever bump into me by accident and wonder aloud what exactly that hard lump is under my shirt, I'll just tell them it's an insulin pump and they should mind their own business.

No biggie. Reminded me of an incident when I revealed once.

In a DQ, wife said a lady was behind me talking to three LEO's and pointing at my waist. She said they all were turned and looking too. A few seconds later she starting giggling as the lady returned to her table.

I asked what happened. She said one of the officers said it looked like a S&W and she shouldn't worry since it was a good gun to carry and the others nodded and agreed and went back to eating. :hysterical:

This is something I worried about when I received my CHP. The first 2 weeks all I was doing was seeing if I was "printing" after those 2 weeks I couldn't care less. Like others have said just check for the no guns sign on the stores door.

It's common to be overly concerned when starting to carry. In fact, the frequent checking, pulling cover clothing, etc will do more at "making" the chp carrier than anything. This is why a good holster with good retention is important.

Does anyone else "FORGET" they're carrying? As to printing, or "peaking"? There are times I am GLAD I am doing that...

Makes certain elements butthole pucker, and sometimes vacate the area.

Appendix carry inside the waist band and you will never print. Not beer gut friendly though.

The 'Back Injury' thread over in General reminded of an incident I had. It could have ended badly, and almost did even though I was laughing so hard I had tears in my eyes. :roll:

A friend and I had missed connections for a few months. One day, on Westover Hills Blvd, 500 block for those who know the area in Richmond. we saw each other and stopped beside the road to talk.
I was having lots of trouble with my L-4. I was also carrying in the small of my back. I was standing outside his truck and we were catching up and his wife was fussing about the delay in getting to Mcdonalds. Over and over I might add. said she was hungry. :clap:

Well, all of a sudden she pipes up with "WOW! Look at that! WTH????"
I turned to my left and see three police cars coming down the wrong side of the road, and 4-5 on the other side as those came flying over the median.
I looked to my right and 4 or more were coming form the other direction and crossing the median. There were 2-4 cops in each car too!
I stood still as they were scrambling and pointing pistols across the hood, and through the windows of the truck. One was even covering the wife. Most were behind me and saying not to move, etc..... Two put their hands on my back and said "hold still" while one disarmed me. Harve looks at me and the 7-8 guns pointed at us through the windshield and over the hood and says "Whoowee! Those look big from this end! I've never looked at one from here before!" I agreed as the PD patted me down and I handed them my license. Most even had fingers on the trigger.
As the one in charge said he saw me and the gun, he didn't pay it any attention until he realized my hand appeared to be on it and he thought I was going to shoot the truck occupants. In truth, and I started to explain it, because I was using my knuckle to alieve(sp) some of my back pain. People with back pain will understand this.

The wife suddenly and plaintively says "I ain't even hungry now, let's go home." She was almost in tears. Well, that tore it and Harve and I were laughing so hard I was down to my knees and THIS REALLY pissed the PD off! Through our tears, Harve and I tried to explain it while 4-5 PD were lecturing us on how NOT funny the situation really was. We knew that, but the timing, facial expressions, etc. overrode common sense.
I'm giggling as I write this, btw.

If you get anything of use from this, it's to hold still, don't go into an aggressive mode, ie; chin out, chest puffed up, tense up and resist the PD. Just relax. They want to go home too and in tense situations, sudden moves can get somebody hurt. :!:

This is why I pocket carry. Way more convenient than a belt mounted holster, especially when wearing cargo pants.

....Oh wait a minute that's my training kicking in when my wife asks "is that new gun ya got there"

Seriously though as long as your legal to carry and respectful if a situation like that occurs I wouldn't sweat it.
