Well, this is interesting. It looks like Falls Church City is considering bringing their gun laws into compliance with the state laws.

They are considering removing their laws from the books, which technically are not valid due to preemption but they continue to enforce them.

I don't believe they enforce them. At least I've OC'ed in Falls Church many times and nothing has ever happened to me. The VCDL has protested in their council chambers at least twice that I know about, and nothing happened.

And if I'm not mistaken, if they do try to enforce their local laws then they could be fined. Given that Falls Church is facing a severe budget shortfall at this moment, they probably don't want to engage in that kinda stuff.

There is no pre-emption, because the city is not a parallel government. It's a municipal corporation, a creation of the state, and has only the powers which the state assigns to it ("Dillon Rule").

Dan Maller, a friend of mine, is an attorney, and a member of the City Council. He has the good sense to save the city money by getting rid of laws which could end up not only being unenforceable, but which could cost the city a lot of money if anyone chose to file suit over them. A very wise man, in my estimation.
