Action on "Castle" and "Stand" Law for Virginians

Postby albertshank » Thu, 15 Apr 2010 21:59:38

Good Evening Fellow Gun Owners and Patriots of This Great Commonwealth!

This morning at 0530, I put the "finishing touches" on the proposed "castle" and "stand" doctrine suggested for citizens of the Commonwealth and forwarded it in "Word" format attachment to our own Mr. Philip Van Cleave, President of the Virginia Citizen's Defense League. I asked Mr. Van Cleave to circulate the finished format among our attorney members and, in effect, to "run it up the flagpole" and "see who salutes it".

I incorporated a very clear "immunity from civil liability" section and "immunity from criminal prosecution" proviso for all cases of lawful self defense or defense of others in the use of our firearms. I also added a section wherein the State would bear all costs of the trial and prosecution of the criminal and the defense of the victim should the defense prove "righteous" and lawful. I would like to think this is a clear and unambiguous proposal that rightfully protects all who use their firearms in legitimate self defense and, above all, sends a clear message to the burgeoning and remorseless criminal element within this state.

A few days ago, we suffered the ruthless and intentional murderous assault of two young people, a young man and a very young woman in his company. They were innocently passing their day on the Parkway and were remorselessly attacked and gunned down as they sat, by a ruthless, shotgun wielding maniac. The young man died of his injuries and the young woman was severely wounded! As I've heard it said: "Who Needs a Gun On the Blue Ridge Parkway"? Well, it seems these young people were ambushed and even if they had been armed, they might not have had a decent chance to defend themselves. I note with sardonic irony that the reports in the media said the local authorities were "confused" as to why the young man tumbled some 150 feet down the side of the mountain. Surely, even they know that the force of the full impact of a shotgun blast will knock you right off your feet and fling your hapless body some distance, particularly if you are struck full force! To me, this is such a "no brainer"! To even raise such a question in speculation seems totally insensitive to the victim and his family. Frankly, this angered me!

At this point, I have no idea where my "castle" and "stand" proposal might go. We are all busy at this time getting ready for the Great 2-A March in Washington this coming Monday, April 19, 2010. However, we have time and I am certain we'll get some cognitive feedback on this soon enough. I'll keep you all posted. I hope to see (and meet) each of you next Monday in the District! Remember to leave your guns and ammo at home!! God Bless and Take Care!

Respectfully submitted,

Albert.

Big kudos to you Mr. Shank...

Lets hope to see it go somewhere, but only if some of those antis in the house and senate can be ousted...
No more catchy slogans for me...I am simply fed up...4...four...4...2+2...

I don't know if Tim Davis is someone I'd want to use as an example in this case...
