So I have read the requirements for a chp in VA a thousand times. The only concern I have is being denied for having 2 misdemeanors over the last 5 years. A drunk in public over 4 years ago and a trespass to fish over a year ago. These are class 3 and 4 misdemeanors. My interpretation is it would be at the judges discretion. What do you guys think, would I likely be denied?
From the virginia state police website- An individual who has been convicted of two or more misdemeanors within the five-year period immediately preceding the application, if one of the misdemeanors was a Class 1 misdemeanor, but the judge shall have the discretion to deny a permit for two or more misdemeanors that are not Class 1. Traffic infractions or reckless driving shall not be considered for purposes of this disqualification.

I'm not a lawyer, but I suspect that a judge would go on and grant it.
Of course, if you don't feel like going before a judge, you could open carry for a while, until that drunk in public was comfortably past the 5 year mark.

I would guess that the judge would probably go on and issue the permit, but YMMV. I would go in prepared with all kinds of positive information about yourself: how you have matured in the last few years, how married life/new job/kids, etc. have given you a new outlook, how you quit drinking so much,how you have a perfect driving record. Other wise, I would wait until the 5 year mark had passed. I did some dumb stuff when I was younger, I was just fortunate to not get convicted of any of it. All of it was of a "victimless" nature, unless you include the assault and battery for jacking up the guy who slapped my girlfriend. None of it stopped me from obtaining a CHP, or a DOD security clearance. Judges have a lot of discretion, and put a lot of weight on their perception of you as an individual. You might have some 'splaining to do, but if you are sincere and present yourself as a respectable/respectful person to the judge, you probably have a good chance. In other words, pull up your pants, comb your hair, speak clearly and respectfully, and put on a d**n tie. It'll be worth it.
