HB 825 "American Law for American Courts" will be heard FRIDAY by the Courts of Justice Committee. Please call or email the members listed below to vote yes!

Foreign Law Ban in Virginia Courts by Delegate Bob Marshall
HB 825 will be heard by the Courts of Justice Committee, TOMORROW, February 3, 2012 immediately upon adjournment of the House of Delegates. I introduced HB 825 to prevent Virginia courts or administrative agencies from using foreign law to decide cases or proceedings before them. HB 825 requires that a court or administrative agency find that it has been given the authority, either as a matter of discretion or obligation, to apply foreign law only if it has been spelled out by the General Assembly.

HB 825 does not assume that Virginia courts currently have the authority to impose foreign law unless prohibited.

HB 825 imposes a legal duty to NOT impose foreign law in our state courts. HB 825 will allow for contracts between U.S. companies and foreign companies using foreign law because contract law is exempted by the U.S. Constitution which is provide for in the bill.
