Virginia: Senate Committee to Hear Numerous Pro-Gun Bills on Monday, March 8

Please Contact Members of the Senate Courts of Justice Committee!

On Monday, March 8 at 9:00 am, the Senate Courts of Justice Committee will hear a number of bills recommended by the Special Sub-Committee held this past Thursday.

With less than a week remaining before the 2010 General Assembly ends it is important that these bills be approved and sent to Senate floor!

House Bill 109, sponsored by Delegate Mark Cole (R-88), would repeal the statute which allows the governing body of any county to require the sellers of pistols and revolvers to furnish the Clerk of the Circuit Court with the name and address of the purchaser, date of purchase and the number, make, and caliber of the gun.

House Bill 1092, sponsored by Delegate Anne B. Crockett-Stark (R-6), would give retired law-enforcement the ability to carry a concealed handgun without a permit.

House Bill 1191, introduced by Delegate H. Morgan Griffith (R-8), would allow a circuit court judge to authorize the Clerk of Court to issue concealed handgun permits in instances where the application is complete, the background check does not indicate that the applicant is disqualified, and, after consulting with the local sheriff or police department, there are no other questions or issues surrounding the application.

House Bill 505, sponsored by Delegate Todd Gilbert (R-15) would allow a concealed carry permit holder to carry his or her firearm into a restaurant, provided he or she does not consume any alcohol. HB505 was conformed to SB334 by creating a Class 2 misdemeanor for consumption of alcohol while carrying concealed and stripping retired law-enforcement officer of the ability to drink while carrying concealed.

House Bill 885, sponsored by Delegate Cliff Athey (R-18), would allow any person who may lawfully posses a firearm and is carrying a handgun while in a personal, private vehicle or vessel to keep the firearm secured in a container or compartment in the vehicle or vessel. HB885 was conformed to SB408 by changing the word ôsecuredö to ôlockedö.

House Bill 870, sponsored by Delegate Ben Cline (R-24), would remove the option for a locality to require that an applicant for a concealed handgun permit submit fingerprints as part of the application.

The House Courts of Justice will also hear 3 gun related bills in full committee.

SB89=Requires the Commonwealth attorney be notified and allowed to comment when someone is trying to get their gun rights restored. OPPOSE

SB501= Allows an out of state DUI to disqualify a CHP application if occuring within the 3 year period prior to that application.OPPOSE

SB533=Allows an Ore Tenus hearing to be granted in the case of a CHP permit disqualification.SUPPORT

The emails here are for the entire committee and take a bit to mail but IMHO any response to them is positive and worth some effort.

Isn't that already law ? I thought Bush signed a bill a few years ago concerning that ?

As of yesterday 3/8/10 the following reported out of committee in the House Courts of Justivce with no NAYS and will be going to the floor for a full vote, If you object to any of them as I do contact your Delegate to voice your opinion.

SB89- when attempting to regain gun rights the commonwealth attorney can be notified and speak on the decision. Last thing anyone needs is another opinion when trying to cut the red tape.

SB501- An out of state DUI within 3 years of applying will disqualify a permit applicant from being eligible for a CHP. What comes next?? Speeding Tickets, Parking tickets? Jaywalking? Opens a big door to even more and bigger shafting IMHO

SB533-Permits the clerk to inform an applicant that if denied a CHP they can request an Ore Tenous hearing to air objection or provide evidence to support . The only good one in the bunch!
