Senior Citizen attacked by teens...shoots two

Three teens knocked the 65 year old off his bike on a bike trail and then attacked him. He shot two killing one. I am guessing this is one of those cases that can go either way as far as him being procecuted. If you read the story you will note that they dont mention the attack until near the end of the article.

They aren't prosecuting the man, he was attacked 3 on 1 with them trying to rob him. There was a numbers disadvantage, they are much younger, they were committing a felony etc. etc. etc.

Berks County District Attorney John T. Adams and Cumru Township Police Chief Jed Habecker will hold a press conference today at 3 p.m. at the Berks County District Attorney’s Office to discuss the fatal shooting that occurred Wednesday in the township.

The District Attorney’s decision on justification will be announced at that time


Hopefully we will hear more on this

And hopefully he walks. These cases always worry me as you never know how they will turn out.

I agree that this is a sad and sobering story. And I agree that the title was misleading. The shooting seems to have occured during an attempted robbery and not just because the three thugs knocked the man off his bicycle.

Sometimes I wish that Paul Harvey was still with us and able to inform us with "the rest of the story" along the lines that the grand jury decided that the attempted-robbery victim was justified for the shootings and opined unanimously that the third thug was lucky to not get shot too because the legally armed citizen was only carrying a double barreled derringer and that he was legally blind in an eye.

yeah that is kind of biased the misleading way they frame it at first to sound as if he just shot them for bumping him. I wonder how many people just skim the headlines and never read the story go away thinking "just a gun nut"

Perhaps a hopeful sign for the for the victim (the 65 yr old man) - the police released him after consultation with the District Attorney, who according to Wikipedia, is a Democrat. Perhaps there was physical evidence or there were witnesses that confirmed the he was subjected to a violent assault and therefore will not be prosecuted.
