Question: Can I sell a NC resident a long gun?

Postby cttbax » Sat, 31 Jul 2010 17:14:43

I thought for some reason you can sell a long gun to a bordering out of state resident without going through a FFL? Am I off my rocker?

Long gun or handgun it still has to go through a FFL for an out of state sale. Your not off your rocker since you asked before you made a mistake.

You can not sell any gun to a resident of another state without involving a FFL AFAIK.

Unless one of you is a licensee the law says no. IMHO this should be changed for private sales as I consider my personal property mine and as far as the government is concerned its none of their damn business what I do with it.

From the gun act of 1968

B2) From whom may an unlicensed
person acquire a firearm
under the GCA?

A person may only acquire a firearm
within the person’s own State,
except that he or she may purchase
or otherwise acquire a rifle or shotgun,
in person, at a licensee's premises
in any State, provided the saleby law or by official departmental
policy. An officer subject to a disabling
restraining order would violate
the law if the officer received or possessed
a firearm or ammunition for
other than official use. (See Question
Q13 on officers’ receipt and possession
of firearms and ammunition after
a conviction of a misdemeanor crime
of domestic violence. The government
exception does

Weird.

If they're really interested, tell them you'll meet them at your local FFL and handle the transfer through them. An FFL can sell a long gun to an out-of-state resident, so I expect they can do the transfer as well.

There has been talk of such things on other forums.

Wouldn't surprise me at all. The antis have been pushing to close the gun show "loophole" and do away with private sales. They need an incident of a non-licensed dealer committing gun trafficking.

Too much risk of uppity negroes going north and buying guns to bring back to challenge the white power structure.
