You guys must be good friends! :hysterical: AIf 20 or so shady looking characters laughing at my AK and continuing to advance on me, I wouldn't be against firing a few warning shots either regardless of the law. It's better to be judged by 12 than carried by 6. I think that LE could use a little description when looking at the case. I would be really worried about retaliation at this point.

I think the District Attorney does have discretion to reduce the charges in this case, but the bottom line is that he fired his weapon unlawfully and in the State of New York, especially nassau county, thats a free reservation to a shared suite in sing-sing....New York is the worst place to break a gun law.

Gotta agree with GS78 and gunderwood in that this dude's probably toast, based on what we've seen to date. And I hope I'm wrong on this.

In Oregon, here's how a similar situation went down in the 1990's. A bunch of teen vandals were going around smashing windshields with baseball bats. One homeowner got tired of it, and when the kids came to do the same to his car, he shot 'em with a 12-gauge filled with rock salt. The kids' families tried to press charges against the homeowner, but the District Atty. said nope. Apparently rock salt was not viewed as "deadly force" by the Dist. Atty. The kids, however, were arrested and charged with vandalism and willful property destruction! :clap:

Property owner: 1. Vandals: 0.

In addition to all the other points mentioned (no such thing as a legal warning shot, no weapons produced by the gang, etc) he was not inside his house. I think this guy would be screwed even in most of virginia, unless there was a sympathetic cop who arrived on the scene first. If you are outside your house, I'm not sure you can even invoke castle doctrine in most cases, which I am sure NY does not have (and neither do we).

Damn Gunderwood, I have been away from the forum for a bit due to health issues and when I come back this is what I walk into? I thought you did your troll hunting with that BMG of yours, instead I have to read all these complicated arguments that remind me of my college logic and philosophy classes. I think I'll let you guys sort this out but I will say that warning shots are never a good idea in my opinion. If he was smart he would have shut his door, got his family secured in a safe room and set himself up where he had a good defense-able position while his wife talked to 911. Just my 2 cents worth. It's good to be back with you guys.

Welcome back. Hope your health is doing better.

+1 on the comments. He went outside to confront them and in the eyes of the law became part of the problem. Unless they were lighting Molotov cocktails or otherwise were a threat to him if he stayed inside, he is in serious trouble. We can argue if the law should be like that, we can also argue if the prosecutor should drop the case or not, but in NY none of that is likely to happen. Rightly or wrongly I think those are the facts. Perhaps his lawyer can get him off on a technicality, who knows.

Well I have to tell you that in N.J. it is not permitted for a Law Enforcement officer to fire a warning shot and this is impressed on the Recruit while in the Police Academy, so you can be damn sure that he would be on his way to jail as the LEO would only be following his or her training and most time's it would be left up to the person in charge of the Detective Division on that shift to decide what if any charges to bring against the person.

Senior Fires Gun To Scare Attacker

KERR COUNTY, Texas -- A Kerr County man has been arrested in connection with an attack on a senior citizen that investigators said was prompted by his desire for prescription drugs.

Jason Curtis, 32, is charged with injury to the elderly in connection with the Sunday attack. He's being held on a $10,000 bond.

Capt. Scott Prout, with the Kerr County Sheriff's Office, said deputies were called to the home in the 300 block of Westway Drive around 8 p.m. Sunday for a report of an assault with shots fired.

Prout said the 79-year-old victim told deputies Curtis had hit him in the face after he refused to share his pain pills -- the prescription drug hyrdrocodone -- with him.

"There was swelling and redness on the complainant's face," Prout said. "There's evidence to support what he said."

The man, who has since been identified as Joe Close, told deputies when Curtis returned to his home, Close pulled out a handgun and fired one shot, missing him on purpose.

"I just wanted to scare him. I didn't want to wound him," Close said. "I would've killed him and I would've been in the right, defending myself."

Sheriff's investigators agreed that Close fired in self-defense. Prout said at this time that he will not face any charges.

Close said that since the attack, Curtis, his former neighbor, has been ordered to stay away from the mobile home park where they both lived.
