I am currently a cwp holder and have talked my boss into why he needs to defen himself , well low and behold he ask me if he's qualified to get a chp because he says he spent time in a residential substance abuse facility for what he says was a gambling addiction ....don't know how much I believe that part , but would that disqualify him since he voluntarily admitted himself into this facility? Any insight would be great.
Btw I follow this website daily but finally just joined look forward to future discussions with everyone here!

welcome to the forum.

go here: http://www.vsp.state.va.us/downloads/SP ... 1-2011.pdf and get the chp application. read through it paying close attention to items 8D and E along with the accompanying notes and statute references. the answers to those questions, and any supporting documentation required for 'yes' answers, should give a good indication of whether there may be problems with approval.

ive read preety thoroughly and it states for substance abuse treatmeant in residential setting. Now if he is being honest about gambling addiction, he did receive treatment for it in a "substance abuse facility " but for a non substance abuse issue, so its a little bit confusing even for someone like myself who analyzes contracts all day long.

well... i guess it would be best to get an official stance from an attorney then. i, for one, wouldn't make any statement on the form that i wasn't absolutely sure of. wouldn't want to get into hot water for a something that turns into a false statement, risking prosecution and possible loss of firearm rights.

we have a few attorneys that visit the forum, so one might weigh in here.

eta... just to clarify your thread subject line, there's no such animal as a cwp in va. chp all the way. ;-)

An individual who has received mental health treatment or substance abuse treatment in a residential setting within five years prior to the date of his application for a concealed handgun permit.
